- A clear update on how compliance with WHMIS 2015 will play out in the federal arena in 2016 and beyond, including transition periods and requirements for worker education and training about WHMIS 2015.
Federally-regulated employers will need to comply with WHMIS 2015, in line with Part II of the Canada Labour Code and several associated regulations that now include WHMIS 2015 amendments. This includes: Part X of the Canada Occupational Health and Safety Regulations; Part V of the Aviation Occupational Safety and Health Regulations; Part VII of the On Board Trains Occupational Safety and Health Regulations; Part VIII of Marine Occupational Safety and Health Regulations; Part XI of Oil & Gas Occupational Safety and Health Regulations (Proposed amendments are included in the Appendix.).
- Under Part II (Occupational Health and Safety) of the Canada Labour Code, the enactment in 2015 of the Policy Committees, Work Place Committees and Health and Safety Representatives Regulations, which updates and replaces the former Safety and Health Committees and Representatives Regulations.
Among other changes, the new regulations:
- set out the responsibilities of work place health and safety (HS) committee chairpersons
- update employer requirements for effective training of HS committee members and HS representatives
- require work place HS committees to submit and post an annual report
- provide clear requirements for minute-taking by HS committees
- Amendments to update the On Board Trains Occupational Health and Safety Regulations and harmonize them with the Canada Occupational Health and Safety Regulations, in part by updating OHS requirements related to: hazard prevention programs (including ergonomic hazards and other unsafe or harmful working conditions); specific noise exposure levels; and controls to eliminate or minimize workplace violence.
- Amendments in 2015 to several regulations under Part II of the Canada Labour Code to confirm that interns working in the federal public service have the same health and safety rights as regular employees.
