As readers are no doubt aware, after an extensive period of consultation with stakeholders, Bruce Reynolds and Sharon Vogel submitted their expert review entitled “Striking the Balance” to the Ministry of the Attorney General and the Ministry of Economic Development, Employment and Infrastructure on April 30, 2016. The recommended reforms were significant, touching all aspects of lien and trust practice and procedure.
The new Construction Act, R.S.O, 1990, c. C.30, received Royal Assent on December 12, 2017 with full support of all parties. The Construction Act modernization provisions came into force on July 1, 2018, with the prompt payment and adjudication amendments to follow on October 1, 2019.
The new Construction Act features three main priorities: modernization of the Act, promptness of payment, and the effectiveness of dispute resolution in the construction industry. These changes are reflected and discussed in detail throughout the 2019 edition.
These reforms will strengthen the Ontario construction industry, and Ontario’s economy, which will richly repay the effort of all involved in this endeavor.
