Details and specs

An actor ordinarily has a duty of care when engaged in any activity that creates a risk of physical harm to others. Duties to avoid the negligent infliction of economic loss are notably narrow. They do not arise merely because an act creates a risk of economic loss to another, they require a more specific rationale.

This publication describes the principal duties that have been recognized and rules of limitation that accompany them.

Torts: Liability for Economic Harm deals with four principal areas of tort law:

  • Unintentional infliction of economic loss
  • Liability for fraud
  • Interference with economic interests
  • Misuse of legal procedure
