After 15 annual editions of this book under the title “Conduct of a Lien Action”, this 16th edition is retitled “Conduct of Lien, Trust and Adjudication Proceedings”, to reflect the modernization and rationalization of our provincial construction industry credit legislation in 2018.

As readers are no doubt aware, after an extensive period of consultation with stakeholders, Bruce Reynolds and Sharon Vogel submitted their expert review entitled “Striking the Balance” to the Ministry of the Attorney General and the Ministry of Economic Development, Employment and Infrastructure on April 30, 2016. The recommended reforms were significant, touching all aspects of lien and trust practice and procedure.

The Review’s mandate was threefold: modernization of the Act, promptness of payment, and the effectiveness of dispute resolution in the construction industry. These changes are discussed in detail throughout the book.
