  • Employment Standards Act, 2000
  • Effective April 29, 2021, the Employment Standards Act was amended by S.O. 2021, c. 9. The amendments implemented a temporary entitlement to three (3) paid sick days in the context of the COVID-19 pandemic. Employers were newly required to provide three (3) paid sick days for COVID-19 related reasons such as illness, isolation, and appointments to be vaccinated.
  • Effective December 2, 2021, the Act was amended by S.O. 2021, c. 35 to require that employers employing more than 25 employees prepare a “Disconnecting From Work” policy annually. The initial deadline to prepare such a policy in the first transitional year is June 2, 2022. Also effective December 2, 2021, the Employment Standards Act was amended to prohibit non-competition policies and clauses in most employment contracts, albeit with limited exceptions for contracts applying to former company owners. Additional amendments were imposed on temporary help agencies.
  • Effective January 1, 2022, the Act was amended by 2021, c. 40, Sch. 9 to increase Ontario’s minimum wage to $15.00 hourly, and to eliminate the lower minimum wage rate for employees who serve liquor.
