Highlights for this edition

This 2022 edition includes selected sections of legislation on topics from residential tenancies to workplace safety. Newly added to the text in 2022 are selected provisions of civil forfeiture legislation from across Canada. Those provisions relate to the seizure of property and other assets tainted by criminal activity, including drug-related offences.

Select provisions of civil forfeiture statutes have been added to the text relating to the following jurisdictions: Alberta’s Civil Forfeiture Act, British Columbia’s Civil Forfeiture Act, Manitoba’s The Criminal Property Forfeiture Act, New Brunswick’s Civil Forfeiture Act, Nunavut’s Unlawful Property Forfeiture Act, Ontario’s Civil Remedies Act, 2001, Quebec’s An Act respecting the forfeiture, administration and appropriation of proceeds and instruments of unlawful activity, and Saskatchewan’s The Seizure of Criminal Property Act, 2009.

In the 2022 edition of Cannabis Law: The Legislative Framework, two additional new clusters of legislative provisions have been added relating to: community safety orders relating to property use, complaints, and property closure proceedings; and tobacco, vaping and smoking restrictions that implicate cannabis use.

On the topic of community safety orders, select provisions of legislation have been added to the text relating to the following jurisdictions: Alberta’s Safer Communities and Neighbourhoods Act, Manitoba’s The Safer Communities and Neighbourhoods Act, New Brunswick’s Safer Communities and Neighbourhoods Act, Nova Scotia’s Safer Communities and Neighbourhoods Act, Saskatchewan’s The Safer Communities and Neighbourhoods Act, and Yukon’s Safer Communities and Neighbourhoods Act.

On the topic of tobacco and vaping control legislation that also implicates cannabis use, select provisions of legislation have been added to the text relating to the following jurisdictions: British Columbia’s E-Substances Regulation and Tobacco and Vapour Products Control Act, New Brunswick’s Tobacco an Electronic Cigarette Sales Act, Newfoundland and Labrador’s Smoke-free Environment Act, 2005, Northwest Territories’ Tobacco and Vapour Products Control Act and Regulations, and Nova Scotia’s Smoke-free Places Act.

At the federal level, three regulations have been updated in the 2022 text: Cannabis Regulations, Cannabis Fees Order, and Approved Drug Screening Equipment Order. Select provisions of the Excise Act, 2001 relating to duties on cannabis and cannabis products have also been added.

At the provincial level (and as detailed below), cannabis statutes and regulations contained in the 2021 edition have been updated in the 2022 edition relating to the following jurisdictions: Canada, British Columbia, Manitoba, Nunavut, Ontario, and Yukon.
