Consolidated Alberta Family Law Statutes 2022, Softbound book

Availability:

The Consolidated Alberta Family Law Statutes 2022 contains the text of Alberta and Federal legislation and rules that form the basis of family law in the province.

As in previous editions, the book also includes the full text of the principle provincial family law legislation, updated with complete amending information, together with selected federal legislation. The Alberta Divorce Rules are set out, and the book contains essential excerpts from the Alberta Evidence fAct, the Federal Child Support Guidelines, Schedules 1, 2 and 3 to the Guidelines, and the Alberta Child Support Tables.

The most important amendment to family law legislation in Alberta in recent years is that the Family Property Act replaces the Alberta Matrimonial Property Act. This piece of legislation changes the law about property division for common law couples by creating legislated rules. In Alberta, courts will no longer have to make determinations as to whether or not a common law couple is engaged in a "joint family venture", as mandated by the Supreme Court of Canada in Kerr v. Baranow. The presumption of equal division of property acquired during a relationship will now be extended to common law couples who meet the statutory requirements.

Every effort has been made to include all legislation required for the day-to-day practice of Family Law Act. Amendments to the legislation rules and regulations as of February 28, 2022 (Alberta Gazette Vol. 118:04) and March 2, 2022 (Canada Gazette Vol. 156:5) have been incorporated.
