The 2021-2022 Annotated Ontario Employment Standards Act, Print and ProView

As with the previous edition, the 2021-2022 edition reflects Ontario’s continuing response to the COVID-19 pandemic. As part of this response, Ontario promulgated and then amended O.Reg. 228/20, Infectious Disease Emergency Leave. This regulation presently suspends certain provisions of the Act for the period from March 1, 2020 to July 3, 2021. It provides that employees who have had their hours or pay reduced or eliminated due to COVID-19 will be deemed to be on emergency leave and, further, that the reduction or elimination of hours or pay due to COVID-19 are not a lay-off, termination, or construction dismissal under the Act, even if the reduction or elimination of hours or pay extends beyond the time allowed for temporary layoffs under the Act. These employees will be entitled to the continuation of any benefits during the leave period, and to reinstatement when the leave ends. The period of deemed leave ends on July 3, 2021, after which time the “normal” provisions of the Act apply.
