This new 2022 Edition features the amendments to the Divorce Act that came into force on March 1, 2021, which are the most significant changes to the Act in decades. Some of the most important changes to the Divorce Act are as follows:

  • Changes in terminology The terms custody and access have been replaced with parenting.
  • Contact orders These orders will probably be most often used where the relationship between the former spouses and the children's extended family have become problematic.
  • Best interests The Act now provides a non-exhaustive list of factors to consider in determining the best interests of the child.
  • Family Violence The amendments provide a broad evidence-based definition of family violence.
  • Relocation This is a change in the place of residence of a child of the marriage or a person who has parenting time or decision-making responsibility or who has a pending application for a parenting order that is likely to have a significant impact on the child's relationship with any other person who has parenting time, decision-making responsibility or contact under a contact order.
  • Alternative dispute resolution proceedings These proceedings are strongly encouraged in the amended Act where they are appropriate. A legal adviser, now defined in the Act, has a duty to encourage the parties to resolve their issues by means of family dispute resolution.
