Federal Civil Rules Handbook, 2018 Edition

As has been widely publicized, many and significant amendments to the Federal Civil Rules took effect on December 1, 2015. This spate of new rules is intended to lead to more focused, less burdensome, and less expensive litigation in the electronic age. All rules are carefully analyzed in this 2016 edition of Federal Civil Rules Handbook, giving you the benefit of rule-by-rule commentary in a comprehensive and up-to-date guide. The publication provides the text of each rule, followed by the authors' distillation of the rule's purpose and scope, a summation of the core concept of each rule's subsection, and an extended discussion of each rule in application. Also, this publication:

  • Is a quick and easy, up-to-the-minute, one-stop reference tool
  • Offers comprehensive commentary, including more than 1,000 citations to new interpretive cases each year, saving research time
  • Provides expert discussion and practice tips, including practical applications, limitations, and traps to avoid
  • Discusses the future of federal pleading
  • Provides information in e-discovery and e-government privacy
  • Includes a summary of any restyling or substantive changes to a rule

New in this edition:

  • Helpful Explorations of the December 2015 Amendments: Once again, the Rules undergo a substantive wave of revisions. This edition of the Handbook endeavors to assist readers in digesting and applying changes embodied in:
    • Rule 37: with an entirely rewritten spoliation provision that establishes a comprehensive scheme for sanctions relating to the loss of electronically stored information
    • Rule 55: with its clarification concerning relief from final judgments by default
    • Rule 84: which has been abrogated, eliminating the formally-sanctioned forms (except for two new nationally-uniform Rule 4 waiver-of-service forms noted above)
  • Tracking Earlier Procedural Changes: This edition of the Handbook also researches the evolving Twombly/Iqbal pleading standard, the impact of the U.S. Supreme Court's recent personal jurisdiction and class action opinions, the alterations to federal subpoena practice, the revisions to the summary and expert disclosure and discovery procedures, and the proper application of Congress's Federal Courts Jurisdiction & Venue Clarification Act of 2011
  • More than 1,200 new citations, most to opinions from the Nation's federal courts decided between Fall 2014 and late Summer 2015
  • Author Commentary: Year-in and year-out, the most valuable feature of the Handbook is the extensive author commentary, modified every year to account for the very latest developments
