Franchising as a form of business relationship is a prominent fixture in Canadian society. Given the prevalence of franchising in the Canadian economy, it is surprising how little is understood of the franchise relationship. The first part of the publication explains the business and legal considerations involved from both a franchisor's perspective and a franchisee's perspective. A franchisee association can equalize the bargaining power and the economic and informational disparities between a franchisor and its franchisees. The benefits of forming and the mechanics of forming a franchise association are considered in the second part of the publication.
About the Author
David N. Kornhauser, LLB (Dalhousie), MBA (Schulich), is corporate counsel at Macdonald Sager Manis LLP, in Toronto. His practice involves representing franchisors, franchisee associations, franchise advisory councils and franchisees in all aspects of franchise law. Mr. Kornhauser is Chair of the Bar Education Working Group of the FLS, a group formed to educate Ontario lawyers on franchise law, is the Franchise Law editor for Toronto Law Journal, a publication of Toronto Lawyers Association, was co-editor of the Franchising 101, a web-site developed by the members of the FLS to provide basic information on franchise law for Ontario lawyers and is a member of the CFA's Legal and Legislative Committee. Mr. Kornhauser is co-author of Franchisee Associations in Canada (Carswell, 2011).
